We process medical data of our clients. Because of the sensitivity of these data, we consider privacy of paramount importance. In our privacy statement you can read which personal data we process and for what purpose. The privacy statement also states which rights you have.

1. INTRODUCTION

1.1 NECESSARY FOR OUR SERVICES

To be able to provide good care, we collect personal data from you. This is necessary in order to provide good care, to be able to contact you and to take care of the invoicing or declaration. Because we do not provide all services ourselves but engage other service providers for some services, it is sometimes necessary to share data. For example, if we refer you, we will also have to share part of your medical file. We will only do this with your permission and only provide the personal data that is relevant to that service.

1.2 LEGAL OBLIGATIONS

Healthcare providers are obliged to keep medical records for 20 years. If the statutory retention period has expired and you are no longer a client of ours, the data will be destroyed. If you remain a client, we will retain the personal data for the purpose of future treatment.

1.3 TO WHOM DOES THIS PRIVACY STATEMENT APPLY?

This privacy statement applies to all our clients. In addition, this privacy statement also applies when you visit our website, send a birth certificate, are a former client, want to become a client or wanted to become a client but ultimately did not, or we are acting for your healthcare provider.

Our organization is responsible for the collection and use of your data.

2. PERSONAL DATA AND THEIR PROCESSING

2.1 WHAT IS PERSONAL DATA?

Personal data are data that can be traced back to a natural person. There are various categories of personal data, such as data relating to treatments, declarations or invoicing and referrals. When you become a patient with us, we ask you for a number of personal details, such as your name, address, date of birth, account number, telephone number and e-mail address. When you are treated, these data and data concerning treatment and research will be recorded in your medical file. Our electronic system can also record a care plan, contact moments and patient details.

2.2 WHAT DOES PROCESSING MEAN?

The meaning of the term 'processing' is broad and includes: the collection, storage, consultation, use, association and disclosure to third parties who perform certain services for us.

2.3 WHY DO WE NEED CONSENT FOR PROCESSING?

We are not allowed to process your personal data just like that. We need a legitimate reason for doing so. Often this stems from the treatment agreement or a legal obligation. Sometimes it is based on your explicit permission. We will ask you for your permission before treating you. We ask a parent for permission for children under the age of 16. You can withdraw your permission at any time.

If you do not agree, or withdraw your consent, we will not be able to provide you with a proper service. Appropriate care can only be provided if all relevant details are available. In addition, we are obliged to build up a medical file in order to guarantee the quality of (future) care.

3. WHAT DO WE DO WITH YOUR DATA?

3.1 REGISTRATION

If you register, you must also provide your BSN number in addition to the details mentioned under 2.1. We must check this on your identity document. We will not make a copy or scan of it. If necessary, we will ask you for your file with your previous care provider.

3.2 REFERRAL

Sometimes it may be necessary to refer you to another specialist. We only provide the necessary personal details to this specialist. If you make an appointment with this specialist, this is regarded as giving permission.

3.3 PAYMENT

We use your details to send you or your insurer a claim and/or invoice for the treatment. The statement or invoice will contain your name and address details and a specification of the treatment. We keep these invoices for our debtor administration. If an invoice remains unpaid after several reminders, data may be shared with third parties for collection purposes.

3.4 HEALTH INSURER

If you are insured, we will exchange your personal data with the health insurance company. We only exchange the necessary data.

The health care insurer may also request information from the insured person for an examination. Depending on the type of examination, we will have to provide the requested data. The privacy of our clients will always be given priority.

3.5 WEBSITE VISIT

When you visit our website, we may process some data via cookies.

3.6 REPORTING OF INCIDENTS

If something has unexpectedly gone wrong with the protection of your personal data - or we suspect that this is the case - then we will report this to the Personal Data Authority. If this incident relates to your personal data and may involve a high risk to your rights and freedoms, we will inform you as soon as possible.

3.7 PROCESSOR

It may be necessary for data to be shared with third parties, such as one of our ICT suppliers or an administration office. If this third party qualifies as a processor, we will enter into a processing agreement with this party so that your privacy is protected.

4. OBLIGATIONS OF THE CARE PROVIDER

4.1 SECURITY

Healthcare providers have a duty of confidentiality and are not allowed to disclose anything to anyone. All our employees who process client information or who take cognisance of it have undertaken to maintain confidentiality.
Data from your file will only be shared with those involved in the treatment or if you have given permission for that data to be shared. We do not transfer personal data to a country outside the European Economic Area (EEA).

Every care provider may only log in under his/her own account. In exceptional cases it may nevertheless be necessary to gain quick access to a client's file, for example in emergencies.

In addition to the afore-mentioned organizational measures, we have also taken sufficient technical and physical security measures to protect your personal data.

4.2 ACCOUNTABILITY

To meet our accountability obligations, we keep records of processing and any data breaches.

5. WHAT ARE YOU ENTITLED TO?

5.1 RIGHT OF INSPECTION AND COPYING

You have the right to view the information in your file. You can make an appointment to view your file under the supervision of the care professional. You are also entitled to a copy of your file. Personal notes do not fall under this right. Data of third parties in your file will in principle be made invisible.

5.2 RIGHT OF RECTIFICATION

You have the right to correct incorrect personal data. You can also supplement your client file. For example, with a second opinion from another care provider or your own views on treatment. You must also ensure that you notify any changes in your details, for example your home address if you move house or a change of telephone number. For simple changes, just call or email the practice. For a more complex request, you can find where to submit a request at the bottom of the statement.

5.3 RIGHT OF REMOVAL

You have the right to the deletion of data. This removal is not possible in all cases. Consideration must be given to another person's significant interest in retaining the data (for example, litigation or inheritance) and other legal requirements that preclude destruction.

5.4 RIGHT TO COMPLAIN

If you have a complaint about the processing of your personal data, please contact us. If this does not lead to the desired result, you have the option of submitting a complaint to the Personal Data Authority, the supervisory authority in the field of privacy.

5.5 OTHER RIGHTS

You also have the right to information, the restriction of data processing, the right to object to data processing and the right to obtain your data in electronic form.
If you wish to exercise any of your rights, we ask that you make a request in writing. At the bottom of the regulations, you can find where you can submit a request. We aim to respond to your request within four weeks.
